By accessing or using the Platform you confirm that you have read, understood and agree to be bound by these Terms, our Privacy Policy and our Cancellation & Refund Policy. If you do not agree, do not use the Platform. These Terms are an electronic record under the Information Technology Act, 2000 and the rules made under it, and do not require any physical or digital signature.

Definitions

"Client", "User", "You" and "Your" refer to you, the person or business entity accessing the Platform and accepting these Terms. "The Company", "Paybuzz", "We", "Our" and "Us" refer to Paybuzz Payments Private Limited. "Party" or "Parties" refers to both the Client and the Company. "Services" means the services described in Section 3. Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they are taken as interchangeable and refer to the same.

All terms refer to the offer, acceptance and consideration necessary to provide the Services to the Client in the most appropriate manner, in accordance with and subject to the prevailing laws of India.

Services offered

Paybuzz Payments Private Limited is a financial technology company that provides digital payment technology and related services to businesses, including:

  • Bill payments (BBPS) — electricity, water, gas, insurance, EMI, credit card, Fastag and other bill payments through Bharat Connect (NPCI), as a listed Agent Institution.
  • Mobile and DTH recharges across supported operators.
  • NSDL collection services — onboarding and operation of collections on the NSDL network as an authorised Technology Service Provider (TSP).
  • Payment and payout APIs — collection and payout APIs through partner banks and payment aggregators.
  • Verification, gift-code and SMS APIs for business integrations.
  • Dashboard and wallet — reporting, wallet management, fund requests, team and organisation access.
  • Distributor and retailer network — commission-based distribution of the above services.

Payment and settlement for the Services are carried out through regulated banks, payment aggregators, NPCI and NSDL ("Partners"). Paybuzz is a technology service provider and does not itself accept deposits or hold customer funds as a bank. The availability of a Service may depend on Partners and on approval of your account.

Eligibility

You may use the Platform only if:

  • you are at least 18 (eighteen) years of age and competent to enter into a binding contract under the Indian Contract Act, 1872;
  • if you act for a business, you are duly authorised to bind that business, and the business is validly registered and in good standing under the laws of India;
  • you are not barred from receiving the Services under the laws of India or any other applicable jurisdiction; and
  • you complete the Know Your Customer (KYC) and verification process required by us and our Partners.

Persons under 18 years of age must not register for or use the Platform. We may refuse, suspend or close any account that does not meet these eligibility conditions.

Account registration & KYC

To use most Services you must register an account and submit KYC documents as required under the Prevention of Money Laundering Act, 2002, applicable RBI directions and our Partners' requirements. You are responsible for keeping your login credentials, Organisation ID, API keys and OTPs confidential, and for all activity carried out under your account, including by team members you add. Notify us immediately at support@paybuzz.in of any unauthorised use.

Accuracy of information

You agree that all information you provide to us — including identity, business, KYC, bank and transaction details — is true, accurate, current and complete, and you will keep it updated. You are solely responsible for the accuracy of payment details you enter, such as biller details, consumer numbers, mobile numbers, account numbers and amounts. Paybuzz is not responsible for any loss arising from incorrect or incomplete information provided by you.

We make reasonable efforts to keep the content on the Platform accurate, but we do not warrant that information on the website is complete, accurate or up to date. Biller, operator and Partner information is provided by third parties and may change without notice. We may correct any errors or omissions at any time.

Use at your own risk

Your use of the Platform and the Services is solely at your own risk. The Platform is provided on an "as is" and "as available" basis. We do not guarantee that the Platform will be uninterrupted, timely, secure or error-free, or that every transaction will succeed, as transactions depend on banks, billers, NPCI, NSDL, networks and other systems outside our control. You are responsible for evaluating whether the Services are suitable for your business, and for maintaining your own records of transactions.

Prohibited activities

You must not use the Platform, directly or indirectly, to:

  • carry out any activity that is unlawful under the laws of India, including money laundering, terrorist financing, fraud or tax evasion;
  • process transactions for illegal goods or services, gambling or betting not permitted by law, unregulated deposit schemes, chit funds, multi-level marketing or pyramid schemes, cryptocurrency dealings not permitted by law, or any business prohibited by RBI or our Partners;
  • provide false, misleading or forged information or documents, or impersonate any person or entity;
  • split transactions, misuse commissions or cashback, or otherwise attempt to circumvent limits or controls;
  • share, sell or sub-license your account, credentials or API keys to any unauthorised person;
  • attempt to gain unauthorised access to, probe, scan, reverse-engineer, overload or interfere with the Platform, its APIs or its security;
  • upload or transmit viruses, malware or any harmful code;
  • scrape, copy, republish or redistribute content from the Platform without our written permission; or
  • use the Platform in any way that harms Paybuzz, our Partners, other users or the public.

We may block transactions, freeze funds, suspend or terminate accounts, and report activity to law-enforcement agencies, the Financial Intelligence Unit – India (FIU-IND) or other authorities where required by law.

Fees, commission & wallet

Fees, charges and commissions for the Services are as communicated to you on the dashboard or in your commercial agreement with us, and are exclusive of applicable taxes (including GST) unless stated otherwise. Commission is credited to your Paybuzz wallet as per the applicable commission structure. We may revise fees and commissions with prior notice. Wallet balances may be used only for the Services and are subject to applicable RBI directions and Partner terms.

You grant Paybuzz a non-exclusive licence to use, reproduce, edit and authorise others to use, reproduce and edit your Comments in any form, format or media.

Hyperlinking & iFrames

Government agencies, search engines, news organisations and online directory distributors may link to our website without prior written approval, provided the link (a) is not deceptive; (b) does not falsely imply sponsorship, endorsement or approval; and (c) fits within the context of the linking party's site. Other organisations may request approval by emailing support@paybuzz.in with their name, organisation, contact details, site URL and the URLs they intend to link to; please allow 2–3 weeks for a response.

Without our prior written permission, you may not create frames around our webpages that alter the visual presentation or appearance of our website. We may ask you to remove any link to our website at any time, and you agree to do so immediately.

Third-party services

The Services rely on third parties such as banks, payment aggregators, NPCI / Bharat Connect, NSDL, billers and telecom operators. Their services are governed by their own terms and policies. Paybuzz is not responsible for delays, failures, downtime or errors caused by such third parties, but we will reasonably assist you in resolving issues with them through our support and dispute process.

Disclaimer & limitation of liability

To the maximum extent permitted by the applicable laws of India, we exclude all representations, warranties and conditions relating to the Platform and its use. Nothing in this disclaimer will:

  • limit or exclude our or your liability for death or personal injury;
  • limit or exclude our or your liability for fraud or fraudulent misrepresentation;
  • limit any of our or your liabilities in any way that is not permitted under the applicable laws of India; or
  • exclude any of our or your liabilities that may not be excluded under the applicable laws of India.

Subject to the above, Paybuzz shall not be liable for any indirect, incidental, special or consequential loss, or for loss of profit, business, goodwill or data. Our total aggregate liability arising out of or in connection with the Services shall not exceed the fees actually received by Paybuzz from you for the specific transaction giving rise to the claim. These limitations govern all liabilities, whether arising in contract, in tort (including negligence) or for breach of statutory duty.

Indemnity

You agree to indemnify, defend and hold harmless Paybuzz Payments Private Limited, its directors, officers, employees, agents and Partners from and against any and all claims, losses, liabilities, damages, penalties, fines, costs and expenses (including reasonable legal fees) arising out of or relating to:

  • your breach of these Terms or any applicable policy;
  • your violation of any law of India or the rights of any third party;
  • any inaccurate information or documents you provide;
  • any fraudulent, unauthorised or prohibited transaction carried out through your account; and
  • any content or links on your own website or application relating to the Platform.

This indemnity survives the termination of your account and these Terms.

Suspension & termination

We may suspend or terminate your access to all or part of the Platform, with or without notice, if you breach these Terms, if we are required to do so by law, a regulator or a Partner, or if we reasonably suspect fraud or misuse. You may close your account by writing to support@paybuzz.in. On termination, any amounts due to either Party will be settled after adjusting for pending transactions, chargebacks and liabilities, and records will be retained as required by law.

Refunds & disputes

Refunds and cancellations are governed by our Cancellation & Refund Policy. Complaints and disputes are handled under the dispute resolution mechanism, timelines and escalation matrix published on our Support page. You agree to first raise any dispute with us through that process before approaching any other forum.

Governing law & jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of India, including the Indian Contract Act, 1872, the Information Technology Act, 2000, the Payment and Settlement Systems Act, 2007, the Prevention of Money Laundering Act, 2002, the Digital Personal Data Protection Act, 2023 and applicable RBI and NPCI directions, without regard to conflict-of-law principles.

Changes to these terms

We may amend these Terms and our linking policy at any time by posting the revised version on this page. Changes take effect when posted. Your continued use of the Platform after changes are posted means you accept the revised Terms.
